“Morgan Hill” Case Notice

Dear Parents/Guardians:
The District was recently notified by the State Superintendent of Public Instruction, Tom Torlakson, regarding pending lawsuits known as the “Morgan Hill” cases. Similar notifications were sent to every school district and SELPA in the State of California.
Mr. Torlakson’s notification indicates that various student records will be produced by CDE as part of those lawsuits. The court has ordered CDE to release the records under a protective order concerning their use. These records contain personally identifiable information for a large number of public education students. Records will be released by the California Department of Education, not the McFarland Unified School District.
These lawsuits focus on compliance with the Individuals with Disabilities Education Act (IDEA) and Section 504 programs; however, there is no guarantee that the information to be released by CDE pertains only to students engaged in one or more of these programs. The District has not been provided any information that would specifically indicate whether or not these records pertain to your student(s).
If you do not object to the disclosure of the information described above, you do not have to do anything. If you object to the disclosure of your or your child’s protected personal information and records, you must notify the Court by April 1, 2016, in one of two ways.
First, you may print out and complete the “Objection to Disclosure of Student Information and Records Case No. 2:11-CV-03471” form at the CDE’s website (www.cde.ca.gov/morganhillcase), and mail your objection to the Court at the following address:

Second, you may write a confidential letter to the Judge, including the name of the student on whose behalf you are writing, your name and relationship to the student, the student’s date of birth, county, school district, and school, and, if you wish, the basis of your objection.
Again, the District is not releasing these records; we are providing this notice to you so you can determine whether or not to object to the release of records by CDE.

Queridos padres/tutores:
El Distrito Escolar de McFarland fue notificado recientemente por el Superintendente de Instrucción Pública, Tom Torlakson, que hay juicios pendientes conocidos como los casos de "Morgan Hill" que van a impactar su privicidad. Notificaciones similares fueron enviados a cada distrito escolar y SELPA en el Estado de California.
La notificación del Sr. Torlakson indica que varios registros de los estudiantes serán producidos por el Departamento Estatal de Educación (CDE) como parte de esas demandas. La corte ha ordenado CDE que proporcionar estos registros. Estos registros contienen información de identificación personal para un gran número de estudiantes de educación pública.
